A third-party pledge is when those agreeing among themselves about public matters which are likely to be improper or not in accord with justice, or from which some harm will result to the public good of the state by reason of what has been done under the terms of the agreement, [these people] having settled on a certain payment deposit the money with a person trusted by both of them and, having determined the matter as seems best to both parties, finalize the arrangements.
